JAS Mobile Broadband bid 75.7 billion baht during the 900-megahertz spectrum auction and recently defaulted on installment payments. The company has been warned that it will be held liable for any damage caused by the company’s default.
The National Broadcasting and Telecommunications Commission (NBTC) announced that a new auction will be held on May 27 for the 900MHz license. The reserve price for the license is set at JAS’s winning bid of 75.7 billion baht. Experts on the NBTC’s advisory panel will determine JAS’s compensation liability on April 28.
The exact amount of compensation that the company will need to pay is dependent on the second auction.
Three key elements have been taken into account by the panel: damage due to defaulting, possible license revocation for Jasmine International and damages caused by other involved parties.
JAS will have to pay 100 million baht to the NBTC for operating expenses incurred for the primary auction and 20 million baht for the auction taking place in May. The NBTC further announced plans to contact the Industrial and Commercial Bank of China and the Bangkok Bank to discuss why the banks failed to loan money to JAS.
The NBTC will need to contact the banks to further investigate why JAS defaulted on their payment. Penalties placed against the company will be better understood after speaking with the banks.
